Registration of Temporary Outlets
Registering your Place(s) of Business and Fee Calculation
As part of the application to become a registered dealer, the dealer must register with the Registrar of Regulated Dealers (“Registrar”) the fixed place of business at which the dealer carries out a business of regulated dealing or a business as an intermediary for regulated dealing (“regulated activity”). If the dealer has no fixed place of business, the dealer must register either of the following places:
(a) The dealer’s registered address, if the dealer is a business entity; or
(b) The dealer’s residential address, if the dealer is an individual.
Temporary Outlets
1. Apart from the registered place(s) of business, some registered dealers may temporarily conduct the regulated activity at another location for a short period of time. Examples of such temporary outlets may include push cart operators, night market stall operators, booths at trade shows, or booths at shopping centre atriums.
2. If the registered dealer intends to carry on or carries on the regulated activity at the location for a total of more than 90 days within a calendar year (i.e. from 1 January to 31 December), the outlet is not considered a temporary outlet and the registered dealer is required to register this location as a place of business in addition to the dealer’s registered place(s) of business. This means that:
(a) At least 14 days before commencing any regulated activity at that place of business, the registered dealer must notify the Registrar (see instructions). After notifying the Registrar, the registered dealer is also required to register this location as an additional place of business under its licence by submitting an amendment application via GoBusiness Dashboard.
(b) At least 14 days before ceasing regulated activity at that place of business, the registered dealer must notify the Registrar (see instructions). After notifying the Registrar, the registered dealer must remove the place of business from its licence by submitting an amendment application via GoBusiness Dashboard.
3. If the registered dealer intends to carry on or carries on the regulated activity at a location for a total of 90 days or less within a calendar year (i.e. from 1 January to 31 December), the registered dealer need NOT register this location as an additional place of business under its licence. Additionally, the registered dealer is NOT required to notify the Registrar before it commences or ceases any regulated activity at that location. The Registrar will not include this location in the maximum number of place of business specified at Annex A of the Regulated Dealers Certificate of Registration.
4. Please note that the Registrar retains the discretion in exceptional cases, to require the registration of a location (apart from the registered place(s) of business), the corresponding payment of registration fees for the location and notification to be given to the Registrar before the commencement or cessation of any regulated activity at that location, even though the registered dealer may intend to carry on or carries on the regulated activity at that location for a total of 90 days or less in the calendar year (i.e. from 1 January to 31 December). The Registrar will notify the registered dealer in writing if that is the case.
Illustration:
Dealer A has registered to act as or hold out to be a regulated dealer. The Registrar permits Dealer A to carry out the regulated activity at a maximum number of 1 place of business. Dealer A operates 1 outlet at 1 Gold Road. Dealer A plans to conduct regulated activity at a stall at a shopping centre atrium for a total of 100 days a year at ABC Centre Atrium. Dealer A must notify the Registrar at least 14 days before commencing to carry out any regulated activity at ABC Centre Atrium (see instructions). After notifying the Registrar, Dealer A must submit an amendment application via GoBusiness Dashboard, to increase the maximum number of places of business at which it is permitted to conduct regulated activity to 2 places of business. Dealer will need to pay registration fees upon approval of the 1 additional place of business for the remaining portion of its registration.
Dealer A also wishes to conduct regulated activity at a booth at a pasar malam for a total of 14 days a year on Diamond Road. Dealer A need not notify the Registrar before commencing or ceasing regulated activity at the booth, and need not register the booth at Diamond Road as an additional place of business under its licence. |
